1. Acceptance of Terms

By accessing or using the FounderOS platform, its API, and any associated services (collectively, the "Services"), you agree to be bound by these Terms of Usage and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using or accessing this site.

These terms apply to all visitors, users, and others who access or use the Service. FounderOS reserves the right to modify or replace these Terms at any time, with material changes notified via the platform.

2. Description of Service and Use License

FounderOS is an AI-native Operating System for entrepreneurs. We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for personal or commercial project development purposes, subject to these Terms.

You may not:

• Modify, reverse engineer, or decompile the underlying software;
• Use the Services for any illegal or unauthorized purpose;
• Attempt to bypass or manipulate the billing and credits system;
• Use the AI agents to generate harmful, illicit, or defamatory content.

3. Credits, Billing, and Subscriptions

FounderOS operates on a pay-as-you-go credit system alongside optional subscription tiers. You agree to pay all fees and charges associated with your account on a timely basis.

• Credit Purchases: Credits purchased are non-refundable unless strictly required by applicable law. Unused credits do not expire as long as your account remains active.
• AI Usage: Interaction with the AI agents consumes credits at defined rates, which may be updated periodically. FounderOS is not liable for credits consumed by user-prompted errors or dissatisfaction with AI-generated outputs.
• Subscriptions: If enrolled in a Pro or Team plan, subscriptions bill automatically on a recurring basis. You may cancel at any time before the next billing cycle.

4. Intellectual Property Rights

The platform, including its original content, features, and functionality (excluding user-generated content), is and will remain the exclusive property of FounderOS and its licensors.

Your Content: You retain full ownership of any business plans, architecture diagrams, and pitch decks generated by the AI using your input data. By using the Service, you grant FounderOS a limited license to process your data strictly to provide the Service to you.

5. Disclaimer of Warranties and Limitation of Liability

The materials on FounderOS are provided on an 'as is' basis. FounderOS makes no warranties, expressed or implied, regarding the accuracy, likely results, or reliability of the use of the materials on its website or the outputs generated by its AI agents.

In no event shall FounderOS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

6. Indemnification

You agree to defend, indemnify and hold harmless FounderOS and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
